OVERVIEW

This website is operated by Cheecam. Throughout the site, the terms “we,” “us,” and “our” refer to Cheecam. We offer this website—including all information, tools, and services available from this site—to you (“User,” “Buyer,” or “Lessee”), whether you are an individual consumer, event planner, venue, or business, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing or renting something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional policies referenced herein or available by hyperlink. These Terms apply to all users, including without limitation browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site or by purchasing/renting any product or service, you agree to be bound by these Terms. If you do not agree to all the terms, you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

We reserve the right to update or change these Terms at any time. It is your responsibility to review this page periodically for changes. Your continued use of or access to the site following posted changes constitutes acceptance of those changes.


1. ONLINE STORE TERMS

  1. Eligibility

    • Users must be the age of majority in their state/province (or have explicit guardian consent) to use this site or make purchases/rentals.
    • Organizations (e.g., event planners, venues, or other businesses) warrant that the individual accepting these Terms has the authority to bind the organization.
  2. Usage Restrictions

    • You may not use our products or services for illegal or unauthorized purposes.
    • You must not violate any laws in your jurisdiction (e.g., copyright laws).
  3. Breach or Violation

    • A breach of these Terms may result in immediate termination of your account or purchased service.

2. GENERAL CONDITIONS

  1. Right to Refuse: We reserve the right to refuse service to anyone at any time, for any reason.
  2. Data Transfer: Your non-credit-card data may be transferred unencrypted across various networks. Credit card information is always encrypted during transfer.
  3. No Resale or Exploitation: You agree not to reproduce, duplicate, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

3. ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

  1. “As-Is” Information: We are not responsible if information on this site is not accurate, complete, or current.
  2. Modification: We reserve the right to modify site contents at any time.
  3. User Responsibility: It is your responsibility to monitor changes to the site.

4. MODIFICATIONS TO THE SERVICE & PRICES

  1. Price Changes: Product or service prices are subject to change without notice.

5. PRODUCTS & SERVICES

  1. Online Availability: Certain products or services (including Equipment rentals) may be exclusively online and have limited quantities.
  2. Accuracy of Display: We strive to display product colors/images accurately but cannot guarantee your monitor’s display.
  3. Quantity Limits: We reserve the right to limit sales or rentals by person, business, geographic region, or jurisdiction.
  4. Product Descriptions: Product descriptions, including pricing, may change without notice.
  5. No Warranty of Expectations: We do not guarantee that our products or services will meet your specific expectations or that errors will be corrected immediately.

6. BILLING & ACCOUNT INFORMATION

  1. Order Acceptance: We may limit or cancel quantities purchased/rented per user, per business, per household, or per order.
  2. Notification of Changes: If we change or cancel an order, we will attempt to notify you via email, billing address, or phone number provided at checkout.
  3. User Obligations: You must provide current, complete, and accurate account information for all purchases. You agree to promptly update your information, including payment data, so we can complete transactions and contact you as needed.

7. OPTIONAL TOOLS

  1. Third-Party Tools: We may provide you with access to third-party tools, over which we have no control.
  2. “As-Is” Usage: These tools are provided “as is” without warranties or endorsements.
  3. Future Services: Any new services or features will be subject to these Terms.

8. THIRD-PARTY LINKS

  1. Third-Party Content: Some content, products, and services may include links to third-party websites not affiliated with us.
  2. No Responsibility: We are not liable for examining or evaluating third-party content or sites and do not warrant their accuracy or legitimacy.

9. USER COMMENTS, FEEDBACK & OTHER SUBMISSIONS

  1. License to Use: If you submit comments or ideas to us (with or without our request), you agree we may use them without restriction.
  2. No Obligation: We have no obligation to maintain comments in confidence or pay compensation.
  3. Content Removal: We may remove content we deem unlawful, offensive, threatening, defamatory, or violating any party’s rights.
  4. Your Responsibility: You agree your submissions will not violate third-party rights or contain harmful code.

10. PERSONAL INFORMATION

Your submission of personal information through our site is governed by our Privacy Policy, which you should review separately.


11. ERRORS, INACCURACIES & OMISSIONS

  1. Right to Correct: We reserve the right to correct errors, inaccuracies, or omissions and to change/update information or cancel orders if necessary.
  2. Timing: We may cancel orders even after you have submitted them if the information is found to be inaccurate.

12. PROHIBITED USES

You are prohibited from using the site or its content for unlawful purposes, infringing intellectual property rights, harassment, uploading viruses, collecting personal information without consent, or interfering with site security. We may terminate your use of the Service for violating any of these prohibitions.


13. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

  2. Results Not Guaranteed: We do not warrant that the results from use of the Service will be accurate or reliable.
  3. Removal of Service: We may remove the Service for indefinite periods or cancel it at any time without notice.
  4. Liability Cap: In no event shall Cheecam or its affiliates be liable for indirect, incidental, or consequential damages. Certain jurisdictions may not allow some limitations, so our liability is limited to the fullest extent of the law.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Cheecam and its affiliates against any claim arising from your breach of these Terms or your violation of any law or third-party rights.


15. SEVERABILITY

If any provision of these Terms is deemed unlawful, void, or unenforceable, the valid portion remains enforceable to the maximum extent permitted by law.


16. TERMINATION

  1. Survival: Obligations and liabilities incurred prior to termination survive termination.
  2. Termination by User: You may stop using our Service at any time.
  3. Termination by Us: We may terminate this agreement without notice if you fail to comply with any term. You remain liable for all amounts due up to the date of termination.

17. ENTIRE AGREEMENT

These Terms and any policies or operating rules on this site constitute the entire agreement between you and Cheecam, superseding any prior agreements or communications.


18. GOVERNING LAW

These Terms and any separate agreements for products or services are governed by the laws of the State of California, without regard to conflict of laws principles. Disputes shall be brought exclusively in the state or federal courts located in California.


19. CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of these Terms by posting updates to our website. Your continued use after posted changes constitutes acceptance.

21. REFUND POLICY

  1. Effective Date: Jan 2025

    At Cheecam, we aim to provide you with high-quality camera rentals and excellent customer service. We understand there may be occasions where a refund is necessary, and we’ve laid out our terms below for clarity and fairness.


    Refund Eligibility

    Before Shipment:

    You’re eligible for a full refund of your order value if you cancel within 30 calendar days of placing your order — unless your order has already shipped, or was placed using a promotional discount of 20% or more (see Discounted Orders below).

    After Shipment (Unused Cameras):

    No refunds will be granted after the cameras ship out or after 30 calendar days of placing your order.

    However, if you decide to return the cameras before your event and do not use them, you may be eligible for a store credit in the amount of your order value, minus a $50 restocking fee and any shipping costs incurred.

    Non-Functional Cameras (Partial Refunds):

    In the unlikely event that a camera arrives non-functional, we will review partial refund requests on a case-by-case basis. Contact us as soon as possible to discuss your situation.


    Discounted Orders

    Orders placed using a promotional discount of 20% or more are ineligible for a full refund, even if canceled before 30 calendar days or shipment.
    In these cases, you are eligible for either:

    • A refund of up to 50% of the order value, or

    • A full store credit to be used toward a future Cheecam event


    How to Request a Refund

    Contact Customer Support:

    Email our support team at support@cheecam.com with your order number and a brief description of the issue or reason for refund.

    Follow Further Instructions:

    Our team will provide instructions for shipping the cameras back if necessary.
    Keep all original packaging and documents to ensure a smooth return process.

    Processing Time:

    Once we receive your request (and any returned cameras, if applicable), we’ll process the refund or store credit within 7–10 business days if you are eligible.


    Special Exceptions

    We strive to be fair with every request, but there are certain cases where refunds or credits cannot be offered (even if you’re within 14 days of purchase). These include:

    • Damage Due to Improper Use or Negligence
      This includes misuse, abuse, improper care, negligence, or accidents (including pet damage).

    • Lost or Recklessly Handled Cameras
      If cameras are lost or damaged due to misplacement or reckless handling, refunds do not apply.

    • Unsatisfactory Film Photos
      We cannot guarantee the outcome of film photos. Any issues resulting from improper handling, lack of flash usage, or user error are not eligible for refunds.

EQUIPMENT LEASE AGREEMENT

(Applies to Rented Equipment)

  1. Parties

    • Lessor: Cheecam
    • Lessee: You (individual, event planner, venue, or organization renting equipment)
  2. Lease Term

    • Begins on the parcel carrier’s first delivery attempt and ends 72 hours after the event date (or a mutually agreed timeframe).
    • Equipment typically ships to arrive 8–10 days before your event, unless otherwise arranged.
  3. Rent & Security

    • All rental fees are paid in full before shipment.
    • Cheecam may require a credit card authorization up to the replacement cost of the equipment.
  4. Use & Ownership

    • Lessee agrees to operate equipment carefully and lawfully.
    • Equipment remains the property of Cheecam at all times.
  5. Condition

    • Cheecam warrants the equipment is in good working order with no known defects when shipped.
    • Lessee acknowledges it may be used equipment with cosmetic wear.
  6. Damages & Loss

    • Lessee bears responsibility for any damage or loss during the rental period, including repair or replacement costs if caused by misuse or negligence.
    • If cameras are not returned at all, you will be billed $50.00 per missing camera.
  7. Return

    • Lessee must return equipment using the prepaid label or instructions by the end of the rental period.
    • No daily late fees apply, but if the equipment is substantially overdue, Cheecam reserves the right to charge the replacement cost (minus any rental fees already paid).
  8. Non-Functional Equipment

    • If a camera is non-functional upon receipt, Lessee must notify Cheecam immediately.
    • Partial refund or replacement may be offered at Cheecam’s discretion.
  9. Liability Waiver for Images

    • Cheecam is not liable if film/digital images fail due to user error, equipment issues, or any other reason.
    • Lessee assumes all risks for achieving desired results.
  10. Indemnification

  • Lessee shall indemnify Cheecam from all claims arising from Lessee’s use of the equipment, except due to Cheecam’s gross negligence or willful misconduct.
  1. Governing Law & Venue
  • This Lease is governed by California law. Any disputes shall be filed in courts located in California.
  1. Entire Agreement
  • This Lease and the Cheecam Terms of Service together constitute the entire agreement. No other agreement—oral or written—supersedes it.
